Leave for appeal filed in relation to application for judicial review

On 4 August 2011, the Company announced that the Court of Appeal of Malaysia had unanimously dismissed the appeal filed by Wong Kin Hoong and others ("Appellants) against a decision of the High Court of Malaya at Kuala Lumpur handed down on 1 June 2009.

The Appellants have been seeking leave from the Courts to bring an action for judicial review against the decision of the Department of Environment in relation to an environmental approval granted by the Department of Environment to Raub Australian Gold Mining Sdn Bhd ("RAGM") back in 1997. The application was brought against the Department of Environment as the first respondent, and RAGM was joined in the proceedings as the second respondent.

In view of the inordinate period of time which has passed since the grant of the environmental approval to RAGM, the Appellants have had to seek leave of the Malaysian Courts before being able to bring an application for judicial review.

On 1 June 2009, the High Court of Malaya rejected the Appellants application for leave to seek judicial review out of time and this decision was subsequently and unanimously supported by the Court of Appeal of Malaysia, comprising a panel of three Honourable Judges, on 3 August 2011. Notwithstanding these decisions, the Company has today received notice that the Appellants, have lodged a Notice of Motion seeking leave to appeal the decision of the Court of Appeal to the Federal Court of Malaysia.

RAGM will continue to vigorously defend its interests and contest this application.
