The complaint is seeking to pursue remedies under Sections 10(b)
and 20(a) of the federal Securities Exchange Act of 1934, and comes
on the heels of similar charges of wrongdoing by the Securities and
Exchange Commission (SEC), the Financial Industry Regulation
Authority (FINRA), and state regulators in Alabama, Mississippi,
Kentucky and South Carolina.
Investors who purchased any of the Funds during the Class Period
may, among other things: (i) do nothing at this time and remain in
the putative class action as "absent class members"; (ii) seek to
be appointed by the court as the "lead plaintiff" in the class
action (on or before June 28, 2010); or (iii) affirmatively opt-out
