E-Data Corporation (OTCBB:EDTA) announced today that The County Patents Court in London issued its ruling on June 8, 2005 in E-Data's infringement suit against Getty Images and Corbis filed by E-Data in early 2004. Despite E-Data's aggressive pursuit of its European patent litigation the Court ruled that neither Getty Images nor Corbis infringed E-Data's European patent EP 0 195 098 B-1, also known as "the Freeny patent." In addition, the Court found that E-Data's patent is invalid. E-Data also announced today that earlier this month, the United States District Court for the Western District of Washington granted Getty Images' Motion for Summary Judgment in E-Data's US suit against Getty and Corbis. In light of these recent decisions, the company is evaluating its prospects both in Europe and the United States. Despite the unfavorable ruling, the company asserts that the Freeny patent covers the downloading and recording of information, such as music, from a computer onto a tangible object, such as CDs, DVDs and MP3 players. The company has secured more than 30 domestic licenses in the U.S. and has received a favorable decision by the Court of Appeals for the Federal Circuit on November 6, 2000 - supporting the scope of the company's patents.
