Centrais Elétricas Brasileiras S/A (“Company” or “Eletrobras”) (B3: ELET3, ELET5 & ELET6; NYSE: EBR & EBR.B; LATIBEX: XELT.O & XELT.B) hereby informs its shareholders and the market in general, in addition to the Markets Annnouncements disclosed on 06/19/2019, 08/07/2019 and 08/28/2019, that the 5th Civil Panel of the Court of Justice of the Federal District and Territories - TJDFT, within the scope of the process number 0048611-24.2014.8.07.0001, filed by Energia Potiguar Geradora Eólica SA and others against the subsidiary Companhia Hidro Elétrica do São Francisco ("CHESF"), after partially accepting the appeal filed by the opposing party, annulled the previous judgment that had been favorable to CHESF.

 

In the same session, it again judged the appeals filed by the parties, to confirm the sentence that condemned CHESF to the payment of indemnity to Energia Potiguar Geradora Eólica SA and others, due to the losses caused by the alleged delay in the delivery of the 230 kV transmission line Extremoz II - João Câmara II, part of the Concession Contract no. 019/2010 and to increase the succumbence fees.

 

The lawsuit is classified as a possible risk of loss, for the estimated amount of BRL 512 million, on December 31, 2020.

 

CHESF understands that it has several matters pending legal assessment and will present the appropriate appeals to the judiciary.

 

The Company will keep the market informed about the progress of the subject matter of this Announcement.
