Administrative Law Judge Endorses Arista’s Redesign in ITC Initial Determination

Arista Networks (NYSE:ANET) today announced that the
Administrative Law Judge (ALJ) at the International Trade
Commission (ITC) has issued an Initial Determination (ID) in the
ITC enforcement proceeding brought by Cisco Systems against Arista.
In the ID, the ALJ found that Arista’s sale of its redesigned
switch products does not violate the cease and desist order issued
by the ITC with respect to U.S. Patent No. 7,162,537 as part of the
underlying ITC Investigation No. 337-TA-944.
“This is an important step in bringing the 944 Investigation to
conclusion and we look forward to the Commission’s Final
Determination, which is currently scheduled to issue no later than
September 20th,” said Marc Taxay, Senior Vice President and General

pleased with his findings that our redesigned products do not
infringe the ‘537 patent and fully comply with the ITC’s
order.”
The ALJ’s decision on the enforcement proceeding follows the
U.S. Customs and Border Protection (CBP) rulings on November 18,
2016 and April 7, 2017 that Arista’s redesigned products do not
infringe the ‘537, ‘145 or ‘592 patents implicated in the 944
investigation and that Arista could again resume importation of its
redesigned products into the United States.
