EPA Proposes Requirements for TSCA Inventory
Notification

(TSCA).
The recent amendments to TSCA, The Frank R. Lautenberg Chemical
Safety for the 21st Century Act (LCSA), require EPA to designate
chemical substances on the TSCA Chemical Substance Inventory as
either “active” or “inactive” in U.S. commerce. On January 13,
2017, the EPA published a proposed rule for comment, which outlines
the requirements for the electronic notification of chemical
substances on the TSCA Inventory that were manufactured or imported
for non-exempt commercial purposes during the ten-year period
ending on June 21, 2016. This proposed rule is not intended to
indicate conclusions about the risk of chemical substances. The
“active” and “inactive” designations will be included by EPA on the
TSCA Inventory. The comment period will end March 14, 2017.
“The proposed rule outlines some of the details the public needs
to prepare for notification, including timing for submittal, who
shall submit, and how to protect your confidential business
information” states Dr. Rose Passarella, Senior Scientific
Regulatory Manager at Intertek. “When this proposed rule is
finalized companies will be required to collect, and organize any
substances that have been manufactured or imported within the last
10 years. If substances are not designated as “active” EPA will
designate them as “inactive” and make them unusable. Companies must
be prepared to respond to avoid delays within their supply chain.
