Your are correct in theory. Under ANCSA and the 'Takings Clause' of the Constitution the US government could use eminent domain to force a road. However, it would not be easy nor quick. The US would need to prove in court that the road serves a genuine public purpose, if it can not then it could be deemed an unconstitutional taking. There are other avenues that could be explored, the State of Alaska has sometimes negotiated easements or land exchanges to facilitate infrastructure projects and the feds could pressure the State to negotiate with Pedro Bay Corp, While the legal framework exists for the feds to exercise eminent domain, applying it to ANCSA lands for the benefit of Pebble Mine, would be unprecedented and legally contentious. Think years or decades of litigation.

Your not gonna like to hear this because it adds insult to injury but under the Alaska Native Claims Settlement Act (ANCSA) of 1971, Alaska Native Corporations (ANCs) generally do not pay federal or state property taxes on their ANCSA land holdings as long as the land remains undeveloped and is not used for business purposes.

President Trump signed an executive order overlooked by some in the media on his first day of office that experts tell Fox News Digital will play a critical role in developing mineral resources in the United States.

"President Biden issued 70 executive actions that discouraged tapping into Alaska's natural resources and public lands access," Gabriella Hoffman, Independent Womenโ€™s Forum Center for Energy & Conservation Director, told Fox News Digital. "Unlike his predecessor, President Trump recognizes Alaska's potential to meet domestic energy and national security needs for reliable energy and critical mineralsโ€”including restoring the Ambler Access Project connecting to the Ambler Mining District."

Research by the University of Alaska Center for Economic Development on the economic impact of the project concluded that the development of the Ambler Mining District could create thousands of direct, indirect, and induced jobs and the project could mean a projected $1 billion for the state in revenue, mining license tax revenue, corporate income taxes, and production royalties.

"Ambler Road is the equivalent of a shoelace on a football field: a blip in the vast remoteness of Alaskaโ€™s wilderness," Power The Future founder and Executive Director Daniel Turner told Fox News Digital. "Yet somehow bureaucrats in DC who do not live there and cannot find it on a map have the authority to prevent Alaskans from developing their own land and growing their economy. Itโ€™s insanity."

"Critical projects in Alaska like Ambler Road and Pebble Mine and oil and gas exploration in ANWR which are held up by radical green ideologues have forced our dependency on China for these raw materials, compromised our national security, but also prevented our fellow Americans in Alaska from the prosperity and economic opportunities they deserve," Turner said.

"So many raw materials we need are in Alaska, and Governor Dunleavy is hamstrung by green insanity in San Francisco and Washington, DC from developing them and growing his stateโ€™s prosperity. The Trump Administration could be the most pro-Alaskan Presidency since Lincoln bought it."

However, the project has faced fierce opposition due to its potential environmental risks, particularly in the area supporting the world's largest sockeye salmon fishery.

Biden administration blocked the project in 2023, while the U.S. Supreme Court rejected the motion against the Environmental Protection Agency (EPA), despite Governor Mike Dunleavy's (R-Alaska) appeal that "the science is there to be able to develop the mine responsibly."

However, the project's fortunes shifted with Donald Trump's re-election. The new administration has prioritized domestic mining and resource development as cornerstones of self-sustainability regarding valuable critical minerals.
Trump has issued multiple executive orders to reverse Biden-era restrictions, such as "Unleashing Alaska's Extraordinary Resource Potential," which directs federal agencies to review and revise actions hindering the state's resource development.
"Executive orders like this give us and the rest of the mining industry comfort that this is an administration with which our industry can do business for the benefit of all," Thiessen noted.

Furthermore, the Critical Minerals Consistency Act โ€“ which recently passed the U.S. House of Representatives with bipartisan support โ€“ recognizes copper as a critical mineral, helping the recognition of the world's largest undeveloped copper deposit further.
Finally, the Federal District Court of Alaska allowed the Northern Dynasty to add the U.S. Army Corps of Engineers to its lawsuit against the EPA. The Northern Dynasty challenged the agency's handling of the permitting process and argued that its veto was unjustified. If the veto is lifted, Northern Dynasty believes the project could move forward based on its Final Environmental Impact Statement (FEIS) findings, which outlines mitigation measures and environmental safeguards.

"Removal of the veto would clear the path for a reconsideration of the 404 application and allow for a fair and impartial decision supported by the comprehensive, transparent, and positive FEIS," Thiessen explained.

The Northeast Expansion Zone will be an immediate and large focus to expand the North Zone, which remains open to the north, east and at depth, with step-out drilling planned to refine its orientation and extent.

Central Zone: The Central Zone links the historical North and South zones. It returned significant intercepts at depth in all of American Eagleโ€™s 2022-24 drilling, but little systematic drilling has been undertaken to date at shallower depths, up-dip of those intersections.

South Zone: Hosts a large-scale gold-rich quartz stockwork mineralized body at surface. Drilling will link the mineralized conglomerate intersected in NAK24-17 and -31 with the broader South Zone.

Step-Out Targets and Emerging Zones: The Southeast Expansion Zone, south of the Babine porphyry, returned long intervals of anomalous gold and copper in NAK22-09 and -36. Soil sampling and mineralized outcrops indicate further potential.

The East Expansion Zone will utilize additional geophysical surveys to refine targets within and around the Babine porphyry, with scout drilling planned to test these areas.

Exploration Beyond Drilling: The 2025 program will incorporate several non-drilling initiatives that will enhance the project.

Geophysics: Aeromagnetic surveying and Controlled-Source Audio Magnetotellurics (CSAMT) to refine targets in underexplored areas north, south, and east of the Babine Stock.

Metallurgical Studies: Testing targeted drill core to assess recovery characteristics across different mineralization styles.

Core Retrieval: Historical drill core (predating American Eagle Gold) for drill holes with significant shallow Main Zone intersections is stored on the NAK property and appears to be in good shape. The Company will relog and resample this core to incorporate it into its model.

Timber Harvesting: Collaborating with local logging groups and the Lake Babine First Nation to manage previously permitted logging blocks, improving access to remote parts of the property.

American Eagle is committed to strong relationships with local stakeholders, including the Lake Babine Nation, provincial authorities, and local contractors.

The NAK Project lies within the Babine copper-gold porphyry district of central BC and has excellent infrastructure through all-season roads. It is close to the towns of Smithers, Houston, and Burns Lake, B.C., which lie along a major rail line and Provincial Highway 16. Historical drilling and geophysical, geological, and geochemical work at NAK, which began in the 1960โ€™s, tested only to shallow depths. Still, the work revealed a very large near-surface copper-gold system that measures over 1.5 km x 1.5 km. Drilling completed by American Eagle in 2022, 2023, and 2024 returned significant intervals of high-grade copper-gold mineralization that reached beyond and much deeper than the historical drilling, indicating that zones of near-surface and deeper mineralization, locally with considerably higher grades, exist within the broader NAK property mineralizing system.

American Eagle benefits from over $37 million in cash, bolstered by two strategic investors formed in the past two years with Teck Resources and South32. With substantial financial and technical resources, American Eagle Gold is well-positioned to drill, de-risk, and define the full potential of the NAK Copper-Gold porphyry project.

There are some pretty big hurdles to get over before this mine ever sees the light of day. After the permitting and getting permission BS there is the giant elephant in the room, getting the ore to market. Because the US is woefully inadequate for processing ore it must be shipped overseas. In order to get the ore from point A (the mine) to point B (the processors) it must go through tribal lands. NAK spells out the difficulty in small print on page 16 of this powerpoint under Assumptions.

Lacking control over the production side of the mineral supply chain puts the nation at the mercy of countries that may or may not decide to sell refined metals, critical minerals, and rare earths to the U.S. in the future. what chinas ban are earths processing technology exports means The Biden admin initiated a fix, but it will take time. The current admin has stuck a fork in the cog of the machine when recently China saw fit to retaliate the tariff talk we all have been hearing about. china expands mineral control. I could go on and on presenting more hurdles (billionaires playground is in Pebbles backyard for example) but what I have mentioned will certainly be enough to delay this mine for the foreseeable future.
