Supreme Court Asks Lower Court to Reconsider Merck Ruling -Reuters

--The U.S. Supreme Court has ordered a lower court to reconsider
a decision to allow certain lawsuits against pharmaceutical company
Merck & Co. (MRK) to move forward, Reuters reports Monday.
--The 3rd U.S. Circuit Court of Appeals had earlier decided to
allow lawsuits, which alleged Merck didn't properly warn users
about possible side effects from its drug Fosamax, the report
said.
--Merck in 2008 gave information to the U.S. Food and Drug
Administration that suggested Fosamax might be linked to certain
types of fractures, but the agency at the time decided against
letting the company add a warning to the drug's label, the report
said.
--Two years later, the FDA ordered changes made to the drug's
label to include a warning, the report said.
