Third quarter doesn't end till later this month and then NLST usually takes about 30 days to report. The 3rd quarter should come out in the last few days of October.

the piss was about 1:38am and couldnt fall back asleep. had dinner made and the produce store done by 9am amongst many other things. even got to spend about 2 hours bastardizing the em7s9 with plenty of fills, forgot to do the laundry though. just had dinner. the golden honey dew i grabbed this morning was best one i ever had in my life........i'm done for the day now... laundry after i get my cup of coffee tomorrow morning though........so hows are favorite pos doing today??? cant wait till scarsi stamps final judgement on that 993...........hoping to get some kind of pay check by christmas. i'll be happy enough if i can pay the prop taxs for the year and get a new central ac unit for next spring. gotta do something with these shares i bought for that trial thats now in november. i think the trading symbols for our beloved ticker should be ROID because it fits. which is cool cuz when it bursts we'll get some relief!!!

NLST A reminder....Scarsi in his own words—quoted by Netlist in Aug 20 doc—where during a hearing he's discussing a pending stay motion in BOC case:

"And I think that my understanding of what Judge Gilstrap would appreciate — as I would if I was in his position — WOULD BE FOR US IN THIS COURT TO RESOLVE THE CASE AND THEN THIS COURT'S DONE AND THEN JUDGE GILSTRAP CAN DO WHATEVER HE FEELS IS APPROPRIATE IN HIS CASE.
I don't know that — I think that the fact that we do have the potential to squeeze this in before his trial is to the benefit of the court in Texas. I mean often we wouldn't have this flexibility but we appear to do now in our schedule.
So again, having considered all the arguments — and I do think that they're good arguments for a stay but I just think the posture of this with this case being proceeding first, I think we have an obligation, I THINK I HAVE AN OBLIGATION TO RESOLVE THE MATTERS BEFORE THE COURT."

$NLST Here are the Responses filed by Netlist to Micron's JMOL Motion regarding Willfulness / Infringement / Damages and Motion for New Trial. This is the 294 case post trial that Netlist won.

They are all sealed, maybe we get the unsealed/redacted versions from Netlist in a week, though Micron's JMOLs are still sealed from Aug 7th.

But to be honest....it is the same arguments rehashed from their initial JMOL filed during trial right before the jury starts deliberating, which was denied, but motioned in order to preserve these issues for appeal, but only if they RENEW their initial JMOL post trial.

We have read enough of their motions and briefs through the cases to get a feel for what it's about. The thing about Micron that makes litigation a bit less convoluted is that there are no issues or aspects with a previous contract and license, eliminating a whole dynamic of disputes that take up time and space as well as muddying everything else between parties, like Samsung.

So what was really going on....or was it nothing at all curious. Was it meant to put pressure on parties, was it meant to strengthen future appeal efforts, was it just scheduling issues, maybe Gilstrap needed help for a bit....or was it judge level Chess?!?!

I don’t purport to know, but let’s look at the interesting sequence of events (these are not all the events/briefs/motions during that period):

Aug 19—parties request Teleconference
Aug 19—Samsung Notice regarding Renewed Stay Motion
Aug 23—Telephonic Conference held
Aug 23—Gilstrap orders mediation
Aug 26—Gilstrap reassigns case to Schroeder
Aug 28—Schroeder reset trial but still in Marshall (Gilstrap court) instead of Texarkana
Sept 9—Schroeder denied Samsung's Renewed Stay Motion (signed 9th/sealed & released 16th)
Sept 12—parties mediate with Folsom
Sept 19—Schroeder reassigns the case back to Gilstrap

What if anything Gilstrap was trying to get ahead of is a mystery, perhaps cutting off any possibility of appeal claims by Samsung similar to what we’ve seen and know they're capable of...I'm sure you can imagine.

Since Gilstrap already denied many Samsung stay motions and 4 in this case, and given he's very familiar with their tactics, the opportunity presented itself to allow another judge—fresh set of eyes & mind—to consider and rule on Samsung’s Stay — which was again a denial that also affirmed Gilstrap's previous denials.

Gilstrap is up against Samsung as well in a away. An appeal is on the judge and their possible error in conclusions or law as well as abusing discretion, in relation to a judgment or procedural. Gilstrap has to make sure his judgment can withstand appeal, so he’s going to do things whose purpose we may not understand at the time.

Why all the trial date changes etc…judges following procedures governing their actions. But it's all very intriguing!

I really thought Judge Schroeder would have been alright,but Judge Gilstrap knows every little thing that Samsung has done (mostly bad) for the last two years + in all the hearings and the 463 trial ,not to say that he judged the same patents in the Micron 294 hearings and trial that will be judged in the 293 case!Once again I am disappointed with the delay but happy Judge Gilstrap is back on this case! After reading Judge Gilstraps order today I think there will be no more delays with the tone he used in his order! I will be ready Oct 8 to witness the pre-trial and rulings on the motions and attend the trial in november.now/ we need a little Scarsi love and make the final ruling on the BOC,hopefully no more delays!GLLs

Stokd $NLST Netlist's Response is due today on Micron's post trial JMOL & New Trial motions in the 294 case won by Netlist. Following is Micron's Reply which is due by Oct 3rd with Netlist's Sur-Reply due by Oct 17th. After that we await Gilstrap's ruling, which presuming is a denial, will start the 30 day clock for Micron to appeal to CAFC. Remember that Final Judgment was already issued by Gilstrap affirming the jury verdict.

Things are progressing nicely whether that's realized and appreciated or not. The way all the many aspects reconcile and when carries heavy implications and can have a big impact. So don't decry the state of things currently and understand there is plenty of we don't know what we don't know as well as behind the scenes activity we're not privy to.

There is a reason for everything whether we understand it or not, so trust the legal team and let it play out!

A special set hearing means that your hearing is the only hearing set before the court on that date and time. Hearings are sometimes set on a general docket, where a number of cases are set on the same date and time, meaning that the court may not have time to hear all the cases set and some will have to be continued.
