INSTRUCTIONS FOR SETTLEMENT CONFERENCES AND
PREPARATION OF CONFIDENTIAL SETTLEMENT STATEMENTS (“CSS”)
for Submission to Magistrate Judge Starnella
Effective August 7, 2023
I. Introduction
If you follow these instructions carefully, I will be able to use my best efforts
towards resolution of your case. On the other hand, if you do not follow these
instructions, I may require that you revise your CSS, or postpone or cancel the
settlement conference. Thank you for your cooperation.
II. Settlement Conference Instructions
A. If the parties’ Confidential Settlement Statements and exhibits are not
submitted by the deadline set by the Court, the settlement conference will be vacated
and sanctions may be imposed.
B. If any party does not follow Magistrate Judge Starnella’s Instructions for
Preparation of Confidential Settlement Statements, the settlement conference will be
vacated.
C. Extensions of the deadline to file Confidential Settlement Statements require
a showing of good cause and should be sought by telephone (303-335-2770).
Extensions must be sought before the deadline expires.
D. Non-parties and non-party representatives, including relatives of parties, shall
not attend the settlement conference without prior written permission of the Court.
Non-parties who attend without permission will be required to leave.
E. All named parties or party representatives shall attend the settlement
conference in person unless excused in advance by Order of the Court. A valid photo
identification is required for entry to the Courthouse.
F. Counsel and the parties should plan to remain at the settlement conference
for at least four hours after it begins. You will not be permitted to leave before that
time for any reason, unless excused by Magistrate Judge Starnella. Travel
arrangements should be made accordingly.
G. Unfortunately, because the Court is a publicly funded non-profit entity and not
a private for-profit enterprise, there is no budget for refreshments to be provided during
the settlement conference, and therefore none will be provided. Please DO NOT ask
Magistrate Judge Starnella or her law clerks for refreshments. You may bring nonalcoholic beverages to the settlement conference.

H. If you have obtained permission to have a party or party representative
appear by telephone, you must provide the telephone.
I. Interpreters are welcome but must be provided at the party/parties’ expense.
J. Compliance with instructions stated herein is mandatory, unless written
permission to deviate from them is obtained in advance. Thank you for your
cooperation.
III. Confidentiality
In our court, in order to protect the integrity of the process, settlement
conferences are confidential. I take this policy very seriously. In conducting the
settlement conference, I will not use information provided in your CSS unless you
explicitly authorize me to do so. (When appropriate, I may suggest that you authorize
me to disclose information.) Therefore, please include in your CSS a designation of all
information that you do not wish me to share with the other party (parties) and/or
counsel (see Section IV.B. 10. below). You may not disclose information exchanged
during the settlement conference to anyone who is not a party to the litigation, counsel
to a party, or counsel’s support staff.
IV. Instructions Regarding Content of CSS
Counsel shall prepare and submit two statements: one to be submitted to the
other party or parties, and the other to be submitted only to this Court, no later than five
business days prior to the date of the settlement conference.
A. Statement to opposing counsel. The first statement is directed to
opposing counsel and opposing parties participating in the settlement conference. It
should contain an overview of the case from the presenter’s point of view, summarize
the evidence that supports that side’s claims, and may present a demand or offer.
These statements should be intended to persuade the opposing parties and counsel.
B. Confidential statement to the Court. The second statement is
confidential and must be emailed to Starnella_Chambers@cod.uscourts.gov and not
submitted for filing or exchanged with the other parties. This statement must attach the
statement to opposing counsel and include the following additional information:
1. Facts of the case;
2. A numbered list of the known significant disputed issues of fact;
3. Computation of damages;
4. Appropriate legal authority;

5. A numbered list of the known significant disputed legal issues;
6. Damages survey (settlements, bench trials, jury awards);
7. Actual and anticipated costs of litigation;
8. History of settlement negotiations;
9. Good faith evaluation of the value of the case, considering the facts,
provable damages, damages limitations (if any), legal issues, witness
strengths and weaknesses, procedural status, timing of trial,
comparable case verdicts, and any other information you believe to be
relevant, AND a good faith explanation of why you value the case as
you do;
10.Preferences for how the settlement conference should be conducted
(i.e., approach to the settlement conference and information that
should not be shared with opposing party or counsel);
11.Any additional confidential comments the party or counsel wishes to
make, such as comments about perceived weaknesses in the case,
any observations about the weaknesses in the opposing party’s case,
and any comments that would be helpful to Magistrate Judge Starnella
in assisting the parties in negotiating a resolution; and
12.A settlement demand or offer.
V. Instructions for Filing of CSS
If you participate in ECF, please e-mail the CSS in PDF format to my Chambers:
Starnella_Chambers@cod.uscourts.gov. Up to 100 pages of additional settlement
materials (e.g. deposition transcripts, exhibits, etc.) may also be submitted to the Court
by e-mail along with the CSS. If you do not participate in ECF, you should mail or
deliver your CSS and additional materials as hard copies, either to the Clerk of the
Court or directly to my Chambers in an envelope marked “Confidential and Private per
Magistrate Judge Starnella Order.”

KOCH COMMERCIAL SCALE DLE TO BE DEPLOYED AT PRAIRIE
HIGHLIGHTS
AZL to deploy the first ever Koch Technology Solutions (KTS) Li-Pro commercial-scale “quad pod” unit at the Prairie Project in Saskatchewan this year. This represents the largest Direct Lithium Extraction (DLE) process ever deployed by KTS and the first commercial-scale production at Arizona Lithium’s Prairie Project.
Koch Technology Solutions is a subsidiary of Koch, Inc., the second-largest privately held company in the United States, based in Wichita, Kansas. The company is a US-based leader in the innovation of DLE and will be a valuable partner for AZL.
Duperow brine from Pad #1 was tested with KTS’s Li-Pro technology and highlighted exceptional results with approximately 98% lithium retention and an average 99% rejection of impurities such as Calcium (Ca), Magnesium (Mg), Potassium (K)and Sodium (Na).
De-risking allows production to be increased by replication of additional Li-Pro units at Pad #1, followed by further deployment of commercial facilities at Pad #2 and Pad #3. Additional Pad locations are also currently being identified for imminent future development.
The Prairie Project in Canada is well positioned to feed battery-grade lithium carbonate into the mature Asian battery market and the rapidly developing North American battery sector. Batterygrade samples produced from the Prairie Project are currently being distributed and tested in Asia.

The facility will feature an integrated, end-to-end direct lithium extraction (DLE) and carbonisation process, enabling the on-site production of battery-grade lithium carbonate.
This demonstration plant is not only the UK's largest permitted lithium brine extraction facility but also the only one currently approved to produce battery-grade lithium on-site.
According to the company, continuous flow trials are a “key differentiator” as they allow for optimal abstraction performance, reservoir measurement, DLE performance optimisation, and the ability to produce multiple large samples of battery-grade lithium carbonate for customer and offtake specification and validation.

Jevons Paradox explains a fascinating - and often misunderstood - economic phenomenon: when advancements in a resource-dependent technology make it more resource-efficient to use, total consumption of that dependent resource can actually go up, rather than down.
The paradox was first described in the 19th century by economist William Stanley Jevons when he observed that improvements in the efficiency of coal engines led to increased coal demand. Essentially, because the resource became cheaper to use, it became more accessible to the masses and, therefore, more widely used, resulting in overall higher consumption.
It's a bit like when you promise yourself that you will start paying more off your mortgage when you get your next pay rise; but when you eventually get the pay rise, you end up moving to a bigger house with a bigger mortgage!
Jevons Paradox has been observed extremely consistently throughout history, especially when the direct underlying resource is energy. However, awareness of the phenomenon remains low, despite its significant relevance to discussions on energy policy and the sustainable development of societies.

Thanks for the clarification, so I am used to IBAT using M.T. most of the time… Either way it's a substantial amount more than they advertise… IBAT normally in the past has referred to Lithium Chloride produced and more importantly it's now Lithium Carbonate at a dramatic increase in tonnage, might be time they update their website to let perspective customers know it's not 5,000 mt a year and could potentially be way over a 100,000 tons a year.
"The Company is anticipating that its patented design will allow access and a means to capitalize on diverse lithium-bearing brine resources. The current plant is capable of producing 5,000 metric tons of commercial-grade LiCl, on a lithium carbonate equivalent basis, each year. The same plant can be quickly expanded to produce up to 20,000 metric tons of LiCl per year, based on the capacity and unique composition of the brine resource."

We agree with Jigar Shah that the U.S. must build out its own lithium infrastructure and, to do so, unconventional technologies will carry the day. All eyes are on the Smackover Formation, where southwest Arkansas alone could hold as much as 19 million tons of lithium, according to USGS. We know the region well; 2022 testing there by Galvanic and IBAT showed up to 89% lithium recovery with our proprietary modular DLE system. Now, as the first commercial-scale DLE operator in North America with a mobile plant design, we are ready to roll and scale, including in the Smackover, to supply domestic lithium for EV batteries and grid storage.

The Rincon Lithium Project – a large, low-cost lithium-brine asset located in the heart of the ‘lithium triangle’ in Argentina – will be a valuable source of rapidly produced, high-quality lithium for the global energy transition.
In December 2024, we announced our investment of US$2.5 billion to expand Rincon, representing our first commercial scale lithium operation. Rincon's capacity of 60,000 tonnes of battery grade lithium carbonate per year is comprised of the 3,000-tonne starter plant and 57,000-tonne expansion plant.

SWA Lithium, the joint venture between Standard Lithium Ltd. and Equinor ASA, said Wednesday, January 15, 2025 that it has successfully commenced drilling a new well into the Smackover Formation at its South West Arkansas Project.
The well is currently at a depth of approximately 8,000 feet below surface and has a targeted total depth of 9,600 feet. The well location is in Lafayette County, south of Lewisville.
SWA Lithium is also undertaking an extensive field program to re-enter the wells drilled in 2023 to conduct detailed reservoir testing and brine sampling work.
All data gathered from this new well will be used to inform the forthcoming front end engineering design (“FEED”) and Definitive Feasibility Studies (“DFS”).
The SWA team is also conducting an extensive field program at four wells in the proposed first area of operation, The work consists of well re-entry, hydraulic testing to determine reservoir characteristics, and brine sampling and testing. In addition, large volumes of brine have been collected from the International Paper Company (IPC-1) to allow the field-based pilot testing to be operated.
The company said in a statement that work has demonstrated that reservoir properties are better than previously gathered in the preliminary feasibility study, and also, where lithium brine samples have been sent off for third-party analysis, the lithium concentrations are higher than previously published. Key data will be made public when available, and all relevant data will be provided in the DFS later in 2025.

The Arkansas Oil and Gas Commission denied the royalty rate application from five companies seeking to extract lithium-rich brine in south Arkansas, a move that will require the companies to come up with another rate proposal and that will cause more delays for the commercial extraction of the mineral.
The five companies – Standard Lithium, Exxon Mobil, Albemarle, Tetra Technologies, and Lanxess Corporation – proposed a rate of 1.82%, which landowners in south Arkansas have argued is too low. During a much anticipated nearly two-day Oil and Gas Commission hearing that began Monday in El Dorado, the companies presented hours of expert witness testimony to make their case for the proposed payout.
The Oil and Gas commissioners voted 9-0 Tuesday afternoon to deny the application. The rate would have been a minimum rate set for over 500,000 acres of land the lithium companies have leased. The royalty rate would be multiplied by the amount of lithium carbonate produced and the price of the lithium to determine an annual royalty payout to the mineral rights owners.
Commercial extraction cannot begin until a royalty rate is set. The companies submitted the application for the 1.82% proposal in July.
