Former United States Securities and Exchange Commission attorney
Willie Briscoe, founder of The Briscoe Law Firm, PLLC, and the

federal class action lawsuit has been filed in the United States
District Court for the Eastern District of Michigan against
Esperion Therapeutics, Inc. (“Esperion”) (NASDAQ: ESPR) and several
officers and directors for acts taken during the period of August
18, 2015 and September 28, 2015 (the “Class Period”).
Shareholders who suffered a loss during the class period have
until March 14, 2016 to seek appointment as lead plaintiff. If you
lost more than $100,000.00 from shares purchased during the class
period and wish to take a more proactive role in the litigation,

According to the complaint, the defendants are alleged to have
violated certain provisions of the Securities Exchange Act of 1934.
Specifically, the complaint alleges, that Esperion issued false and
misleading statements and failed to disclose that it had no clear
path to approval for ETC-1002, the Company’s lead product candidate
designed to lower LDL-cholesterol levels. On August 17, 2015,
Esperion reported to investors material events from an August 2015
meeting with the FDA, stating that the Company was informed by the
FDA during the meeting that it would not have to complete a CVOT to
gain approval of ETC-1002. Then, on September 28, 2015, Esperion
issued a press release noting that the FDA had encouraged it to
initiate a cardiovascular outcomes trial (“CVOT”) and that
completion of a CVOT could be necessary prior to approval of
ETC-1002. Esperion stock dropped significantly immediately
following this announcement.
