You are right, but someone will be an idiot not to hold huge amount of shares and file custodianship, they know that price appreciates multifold even before the court date.
If you want to understand custodianship more, pick up any stock and you will be found that a dead stock goes through heavy volume and price few times before custodianship is filed.
Rather say some smart guys are making algorithms to detect custodianship before even its announced and to detect that they solely look at dead shell, defunct and sudden spike in price and volume, few pump and dump, usually 4-6 weeks timeframe .
There are some who do this manually, going over ihub historical data.

Same as tranche loans for houses. Tranche loans for houses are rated C+, B+, or A+. Well the same goes with empty tickers, they are classified similarly, the ones with the most share structure becomes a risk for SPAC managers so they would put empty tickers with a miniscule share structure in a higher category meaning that anyone wanting those will have to pay a premium, meanwhile the ones with a high share structure pays basement prices for them.
