ITEM 8.01 Other Events

Interleukin Genetics, Inc. (the “Company”) has received a letter from the U.S. Food and Drug Administration (the “FDA”) inquiring about the Company’s Inherent Health brand of genetic tests and stating that these tests appear to meet the definition of a “device” as such term is defined by the FDA. The Company does not believe that its Inherent Health tests are devices that are subject to review by the FDA, and it intends to provide information to the FDA to support its position. There can be no assurance, however, that the FDA will agree with the Company’s position that the Inherent Health genetic tests do not require review by the FDA.
