Item 5.02. Departure of Directors or Certain Officers; Election of Directors; Appointment of Certain Officers; Compensatory Arrangements of Certain Officers.

On September 11, 2019, Kevin Kline submitted his resignation as Chief Operating Officer and General Manager of Montreign Operating Company, LLC d/b/a Resorts World Catskills, an indirect wholly-owned subsidiary of Empire Resorts, Inc. (the “Company”), effective as of September 20, 2019. There were no disagreements between the Company and Mr. Kline on any matters relating to the Company’s operations, policies or practices.
