Cautionary Note Regarding Forward-Looking Statements

This report includes statements that may constitute "forward-looking statements," including statements regarding the Company's business plan, financial performance and the path and milestones for executing a sale of Akorn's business, through the filing of Chapter 11 cases under the U.S. Bankruptcy Code, the Company's continued engagement in discussions with certain of its lenders regarding the process for such potential sale of the Company's business.
