Item 8 .01 . Other Events

On June 23, 2017, the Court of Appeals for the Federal Circuit issued its ruling in Prism Technologies LLC v. T-Mobile USA Inc . The Federal Circuit ruled that the claims of the patents-in-suit (U.S. Patent Nos. 8,127,345 and 8,387,155) recite patent ineligible subject matter under 35 U.S.C. § 101.2. The Federal Circuit also dismissed Prism’s request for a new trial as moot and denied T-Mobile’s request for a determination that the case was “exceptional” under 35 U.S.C. § 285, which authorizes an award of attorney fees to the prevailing party in a patent litigation.

Prism is reviewing the Federal Circuit ’s decision and evaluating its options.
